The Māori Land Court is pleased to announce the public launch of Te Puna Manawa Whenua, the Māori Land Court Bench Book, which is now available on the Courts of New Zealand website.

Developed by judges for judges and published by Te Kura Kaiwhakawā (Institute of Judicial Studies), the bench book offers guidance on what judges may need to know, understand, and do when hearing applications in the Māori Land Court (the Court). Although written for judges, its public release promotes transparency in the justice system, assists Māori landowners and their advisors, and supports educational purposes.

Chief Judge Dr Caren Fox expressed her excitement sharing this resource, stating that it captures a wealth of knowledge about the law relevant to the Court and its jurisdiction. She emphasised that Te Puna Manawa Whenua will also support the development of the whenua and the people who come to Court.

While it is not a comprehensive statement of the law and does not bind judges, Te Puna Manawa Whenua serves as a guide and reference for judges to refer to. However, judges retain discretion over how they use its standard documents and templates and tailor them to the specific facts and legal issues of each case.

Te Puna Manawa Whenua was developed by an editing committee of judges from the Court. It will be regularly reviewed and updated as the law evolves. While every effort has been made to ensure its accuracy, no assurances can be given.
