For instance, an alienation includes the making or grant of any lease, licence, easement, mortgage or charge or any kind of encumbrance or trust in respect of the land in the reservation.
While there are certain requirements placed on other sales/alienation of whenua Māori by the Act, those do not apply to a mortgagee sale.
Granting a vesting order Before granting a vesting order to transfer shares or interests, the Māori Land Court must be satisfied that: • any instruments of alienation have been executed and attested (ie signed and witnessed) in the manner required by the Rules of the Court.
