As in all trustee appointments, these are made by the Court. That forum is where any beneficiaries may raise objections to appointments (criminal convictions or whatever).
These need not be terminated upon appointment to the bench, and subject to actual conflicts of interest arising from knowledge of clients or circumstances, such connections should not generally affect a judge’s impartiality.

Landowners nominate trustees and elect committee of management members who are then confirmed and appointed by a judge or registrar.

The Minister of Māori Development, Willie Jackson, confirmed Judge Thomas' appointment on 22 March 2023.
Her Honour is of Ngāti Porou and Rongowhakaata descent and is the first wāhine Māori appointed to the role. In July 2023, Judge Fox was appointed Chief Judge of the Māori Land Court - Te Kaiwhakawā Matua o Te Kooti Whenua Māori.
