Before applying to the Māori Land Court for an occupation order, you will need consent from the other owners of the land, and if applicable, from trustees or the management committee of the Māori incorporation over the land.

An application fee of $228 is charged for these applications. You can appeal a Māori Land Court decision about access to the Māori Appellate Court by filing in a notice of appeal form (Form 13) stating the appeal is made under section 171 of the Local Government (Water Services) Act 2025.

Any member of the preferred classes of alienees who wishes to be considered by the owners as a prospective purchaser of the land must give written notice of their intention to pursue a right of first refusal at the hearing of the application. That written notice must be filed in the Māori Land Court not later than 18 February 2026 If no notice is filed by the date set out above, the Court may confirm the alienation of the land by way of sale.
