Then lastly, the Court, of its own motion pursuant to section 37(3) of the Act makes a
further order as follows:
Pursuant to section 183(4) of the Act appointing Ropata Taylor and Ihaia Raharuhi as
interim agents for the purposes set out in section 183(6) on behalf of all the owners,
and in particular to negotiate with the Tasman District Council in respect of the council’s
occupation of the land.
Fortunately, as Level 3 unfolded, more technological resources became available for Māori Land Court staff to enable them to work from home. On 11 May 2020, the Prime Minister announced moving into Alert Level 2 in stages, starting at 11:59pm on 13 May 2020.
However, in terms of section 227(6) of the Act,
any trustee whose vote is recorded as against a decision
before it is implemented will not be personally liable.
• Any revenue from the lease or licence must be used as
directed by the MLC.
Section 150A of the Act (as amended by section 24 of
Te Ture Whenua Māori Amendment Act 2002) requires any
lease for longer than 52 years to have the consent of at least
half the beneficial owners of the land and the approval of the
MLC.
The mortgage can be approved by a majority of the members of the Incorporation’s
committee of management, provided that the majority cannot be less than three members
of the committee (s 270(2) of the Act).
11. Where the mortgage has been approved by a majority, the mortgage documents can be
signed as follows (s 270 of the Act):
(a) By fixing the common seal of the Incorporation in the presence of two members
of the committee of management.
Any final terms of trust are subject to confirmation by the Māori Land Court in accordance
with sections 214 or 244 of Te Ture Whenua Māori Act 1993.
