Succession is the legal transfer of interests or shares in Māori
land from a person who has passed away to the people who
are legally entitled to own those interests.
Having a sound title registration system does
not reduce the fragmentation of interests, and removing successors’ direct access to
the Court will arguably add a major barrier to the key mechanism in the Act that
reduces fragmentation of interests – the whānautrust.
That was not the case and Māori in the South Island were left without land and without sufficient resources to take care of themselves and their whānau.
Between 1879 and 1887, several investigations were carried out to investigate grievances arising from that broken promise.
