From 6 February 2021 The Māori Land Court can make rulings about Māori land under the Family Protection Act 1955, Law Reform (Testamentary Promises) Act 1949, Government Roading Powers Act 1989, Local Government Act 1974 and the Property Law Act 2007.
The MLC operates under the provisions of Te Ture Whenua Māori Act 1993 (‘the Act’). Trustees1 are bound by Te Ture Whenua Māori Act and the Trusts Act 2019.

Then lastly, the Court, of its own motion pursuant to section 37(3) of the Act makes a further order as follows: Pursuant to section 183(4) of the Act appointing Ropata Taylor and Ihaia Raharuhi as interim agents for the purposes set out in section 183(6) on behalf of all the owners, and in particular to negotiate with the Tasman District Council in respect of the council’s occupation of the land.

For a period of time, it will only be Judges of the Māori Land Court who can be appointed to act as mediators under Part 3A of the Act.
Most professional mediators will have their own standard Agreement to Mediate, which sets out the rules of the mediation and the basis of the mediator’s appointment. The question is whether the mediation process will allow for mediators to have these agreements signed by the parties, to provide extra protections to them above those provided under the Act.
