Should the Court be guided by the results of an election conducted at a meeting of owners? Is one meeting enough or should there be several, in different locations, if the trust either has a large number of owners or significant assets (or both) and there are large population centres of owners in different localities?
Where land is vested in trustees, the trustees are the
legal owners of the land and they hold it upon trust for the
beneficial owners and they manage that land in
accordance with the trust order set by the Court.
