If an owner of Māori freehold land in multiple ownership has paid more than their share of water services changes, they can apply to the Māori LandCourt for a “charging order” to recover the excess amount paid.
The benefits of an incorporation include:
the ability to establish and run commercial operations for maximum financial benefit to the shareholders
the application of a corporate model to the management of Māoriland
autonomy from the normal Māori LandCourt practices that apply to trusts, and
voting and resolutions by shareholders are based on the number of shares held, rather than the number of votes received.
An ahu whenua trust:
holds the trustees legally responsible for the management of the land, and
uses a Māori LandCourt-approved trust order, which sets out the rights and responsibilities of the trustees and beneficial owners.
