The order will then be written up in the Court title records if it affects land, and will be sent to any party who has to act on it, for example the Māori trustee if the Māori trustee has been ordered to pay money he/she is holding, or a Māori incorporation if the order affects shares in that incorporation.

The Māori Land Court bench have released a practice note for lending money on whenua Māori. Unlocking finance is an important part of facilitating the occupation, development, and utilisation of whenua Māori for the benefit of owners, their whānau, and their hapū and this practice note is another step on the road to realising this vision.
The extent to which they are included depends on: • whether they are related by blood to the deceased • their connection to the whenua • the tikanga of the relevant iwi or hapū Payment of funds Section 242 of Te Ture Whenua Māori Act 1993 If money is being held on behalf of the deceased by a trust or incorporation, the Court can make an order for the payment of those funds to the people determined entitled under the succession application.

It is limited to income (e.g. rents or interest) and excludes capital (e.g. purchase money or compensation for land). When the life tenant dies or re-marries, their life interest ends, and the estate passes to the next-of-kin of the person from whom the interest came (usually their children).
