The Māori incorporation is not required to first offer the lease of Māori land to the preferred classes of alienees. The Māori incorporation does not have to inform the Māori Land Court that it is leasing investment land.

If the Māori land shares are in a Māori incorporation, the preferred class also includes the incorporation itself.
To avoid doubt, this means that a mortgagee can pursue a mortgagee sale without having to meet the requirements placed on other sales/alienations by the Act: (a) There is no right of first refusal to the preferred class of alienee. (b) A mortgagee sale does not have to be confirmed by the Court.
(iii) Next of Kin – where there is no will, or the will is unclear or leaves interests to anyone other than the preferred class of alienee (who are the family of the deceased) then the next of kin for the purposes of succession are children of the deceased; if there are no children then brothers and sisters; if neither of these then next of kin are the nearest relatives on the side of the family from whom the land originated.
