Description of reasons for outstanding
applications
The reasons listed below show thecurrent stage of processing ofthe application through the court.
The conduct of these proceedings would not have been possible without the foresight and commitment oflandowners and the growing desire to have the status and role of te reo Māori recognised and living in all aspects of day-to-day life, including the Māori Land Court.
Occupation orders can
now be granted not only to thelandowner or any person
entitled to succeed to their interest, but also to beneficiaries
ofthe whānau trust that holds a beneficial interest in the
land.
The Act now clarifies that Māori Land Court judges will follow
the tikanga ofthe hapū or iwi associated with the land being
succeeded to when deciding whether whāngai can succeed to
a land interest.
The unique relationship between Māori and whenua is
recognised by the MLC, and the records held by the Court
form an invaluable part ofthe whakapapa of all Māori people.
